Throughout these Terms, “Blatantly British”, “we”, “us” and “our” refer to BLATANTLY BRITISH LTD.


2. These Terms

These Terms explain the rules that apply when you:

Create an account.

Place an order.

Purchase physical goods or digital products from us.

By placing an order, you agree to these Terms and any policies referenced within them.

Our Refund Policy, Shipping Policy and Privacy Policy also form part of these Terms.

Nothing in these Terms affects your statutory consumer rights.


3. Using Our Website

You may use our website only for lawful purposes.

You must not:

Use the website fraudulently or unlawfully.

Attempt to gain unauthorised access to the website, its servers or connected systems.

Introduce viruses, malware or other harmful technology.

Interfere with the operation or security of the website.

Copy, scrape or extract website content for commercial purposes without our written permission.

Use our intellectual property without permission.

We may suspend or restrict access where reasonably necessary to protect our website, customers, systems or legal rights.


4. Age Requirements

You must be legally capable of entering into a contract to place an order.

If you are under 18, you must have permission from a parent or legal guardian before placing an order.


5. Product Information

We take reasonable care to ensure that product descriptions, prices, images and other information are accurate.

Colours may appear slightly different depending on your screen, device and display settings.

Measurements and dimensions are approximate unless stated otherwise.

Many of our physical products are printed to order. Printing a standard product after an order is placed does not automatically make that product personalised.

A product will be treated as personalised only where it is made to your individual specifications or clearly personalised for you.


6. Product Availability

All products are subject to availability.

We may limit quantities, withdraw products or stop accepting orders where reasonably necessary.

If a product becomes unavailable after you place an order, we will contact you and provide a full refund for the unavailable product.


7. Prices

Prices are displayed in pounds sterling.

Prices include applicable taxes where required.

Delivery charges, where applicable, will be shown before you complete checkout.

We may change prices at any time, but a price change will not affect an order that we have already accepted.

If an obvious pricing error occurs, we may contact you before accepting or dispatching the order. You may confirm the order at the correct price or cancel it for a full refund.


8. Placing an Order

When you place an order, you are making an offer to purchase the selected products.

An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that we have accepted it.

For physical products, the contract between you and us is formed when we send a dispatch confirmation, unless we expressly confirm acceptance earlier.

For digital products, the contract is formed when we confirm your purchase and make the digital content available.

You are responsible for checking that your order details are complete and accurate before submitting the order.


9. Payment

Payment must be made using one of the payment methods offered during checkout.

Payments may be processed by Shopify or another authorised payment provider.

We do not directly store complete payment-card details.

You confirm that you are authorised to use the payment method provided.


10. Refusing or Cancelling an Order

We may refuse or cancel an order for legitimate reasons, including:

A product is unavailable.

Payment cannot be authorised.

We identify a clear pricing or product-information error.

We suspect fraud, misuse or unlawful activity.

The delivery address is outside an area we serve.

The order breaches a product restriction or these Terms.

If payment has already been taken for an order that we cancel, we will provide a full refund.

We will not refuse service for an unlawful or discriminatory reason.


11. Changing an Order

Contact support@blatantlybritish.co.uk as quickly as possible if you need to change:

The delivery address.

The selected size or colour.

The quantity ordered.

Other order details.

We may be able to change an order before production begins, but we cannot guarantee changes once printing or fulfilment has started.

This does not restrict any statutory cancellation rights that apply to your order.


12. Delivery

We currently deliver physical products only within the United Kingdom.

Production, dispatch, delivery estimates and shipping charges are explained in our Shipping Policy.

Unless another delivery period has been agreed, goods will be delivered without undue delay and normally within 30 days after the order is placed.

Delivery times are estimates unless we expressly agree that delivery by a particular date is essential.

You are responsible for providing a complete and accurate delivery address.

Contact us promptly if you notice an error in your delivery details.


13. Risk and Ownership

Responsibility for physical goods passes to you when the goods are delivered to:

You.

A person identified by you to receive them.

A safe place or location specifically authorised by you.

Ownership of physical goods passes to you once we have received payment in full.


14. Separate Deliveries

Products within the same order may occasionally be fulfilled separately.

This means that items may arrive in different parcels or on different days.

Where available, dispatch and tracking information will show which products have been sent.

You will not be charged additional delivery fees solely because we choose to split an order into separate parcels.


15. Cancellation and Change-of-Mind Returns

For most standard physical products purchased online, you may cancel your order within 14 days after the day you receive the goods.

You do not need to provide a reason.

To exercise this right, contact support@blatantlybritish.co.uk within the cancellation period.

After notifying us, you must return the goods within a further 14 days.

The conditions, return process, refund timing and return-postage responsibilities are explained in our Refund Policy.


16. Personalised Products

The statutory change-of-mind cancellation right may not apply to goods that are:

Made to your individual specifications.

Clearly personalised for you.

This exception does not apply merely because a standard product is printed after you place your order.

Your rights remain unaffected if a personalised product is faulty, damaged, incorrect or not as described.


17. Faulty, Damaged or Incorrect Goods

We are legally required to supply goods that are:

Of satisfactory quality.

Fit for purpose.

As described.

Contact support@blatantlybritish.co.uk if a product is faulty, damaged, incorrect or not as described.

You may be entitled to a repair, replacement, price reduction or refund, depending on the circumstances and applicable law.

You may have the right to reject qualifying faulty goods and receive a full refund within 30 days of delivery.

Nothing in these Terms limits your rights under the Consumer Rights Act 2015.


18. Refunds

Refund eligibility, return instructions and refund processing times are explained in our Refund Policy.

Approved refunds will normally be issued to the original payment method.

Your bank or payment provider may require additional time to display the refund in your account.


19. Digital Products

Digital products may be delivered by email, download link or another electronic method described on the relevant product page.

Before immediate digital delivery begins during the statutory cancellation period, we may ask you to:

Expressly consent to immediate supply.

Acknowledge that your cancellation right will be lost once supply or downloading begins.

Where valid consent and acknowledgement have been provided and supply has begun, the change-of-mind cancellation right may no longer apply.

This does not affect your statutory rights where digital content is faulty, not as described or does not meet applicable legal requirements.

You must not copy, distribute, resell, share or commercially exploit digital products unless we have expressly authorised you to do so.


20. Discount Codes and Promotions

Discount codes and promotional offers may be subject to separate conditions.

Unless stated otherwise:

Only one discount code may be used per order.

Discounts cannot be exchanged for cash.

Discounts cannot be applied retrospectively.

Discounts may have an expiry date.

Discounts may apply only to selected products or minimum order values.

We may withdraw a promotion where it has been misused, published in error or affected by fraud.

This will not affect an order that we have already accepted unless the promotion was clearly applied in error.


21. Accounts

You may be able to create an account on our website.

You are responsible for:

Providing accurate account information.

Keeping your login details secure.

Notifying us if you suspect unauthorised account access.

We may suspend or close an account where it is used fraudulently, unlawfully or in serious breach of these Terms.


22. Reviews, Comments and Submitted Content

You may submit reviews, comments, photographs or other content where our website permits this.

You confirm that:

You own the content or have permission to submit it.

The content is accurate and not misleading.

The content does not infringe another person’s rights.

The content is not unlawful, threatening, abusive, discriminatory or defamatory.

The content does not contain malicious code or unwanted advertising.

You retain ownership of your content.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, edit and use submitted content for operating and promoting Blatantly British.

We may moderate or remove content that breaches these Terms or applicable law.


23. Intellectual Property

The website and its content, including designs, branding, graphics, text, photographs, product artwork and logos, are owned by or licensed to Blatantly British.

You may view and use the website for personal, non-commercial purposes.

You must not reproduce, modify, distribute, sell, license or commercially exploit our content without prior written permission.

Purchasing a product does not transfer ownership of the intellectual property used in its design.


24. Third-Party Services and Links

Our website may use or link to services provided by third parties, including Shopify, payment providers, delivery companies and social-media platforms.

Third-party services may have their own terms and privacy policies.

We are not responsible for content or services operated independently by third parties, except where the law makes us responsible.

A link to another website does not mean that we endorse all content available through that website.


25. Website Availability

We aim to keep the website available and operating correctly.

We do not guarantee that access will always be uninterrupted or error-free.

We may temporarily suspend or restrict the website for maintenance, security, technical work or circumstances outside our reasonable control.

We will take reasonable steps to restore service where practical.

We are responsible for losses that are a foreseeable result of:

We are not responsible for business losses, loss of profit, loss of business, loss of opportunity or business interruption arising from consumer use of our products.

We are not responsible for delay or failure caused by events outside our reasonable control.

Nothing in this section excludes liability for fraud or fraudulent misrepresentation.


35. Governing Law and Courts

These Terms are governed by the laws of England and Wales.

If you live in England or Wales, legal proceedings may be brought in the courts of England and Wales.

If you live in Scotland, you may bring legal proceedings in Scotland or England and Wales.

If you live in Northern Ireland, you may bring legal proceedings in Northern Ireland or England and Wales.

Nothing in this section removes any mandatory consumer protection that applies where you live.
